These Terms of Use ("Terms") govern your use of skpools.com (the "Site"), operated by SK Pools LLC ("SK Pools," "we," "us"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

About this Site

The Site provides general information about pool service, repair, remodeling, and retail supply offered by SK Pools and its affiliated local companies. It is informational only. Nothing on the Site is an offer, a quote, a warranty, or a binding commitment to perform work. Services are provided only under a separate written agreement signed by you and the applicable SK Pools company.

Licensing

SK Pools LLC holds California CSLB C-53 Swimming Pool contractor license #1063945. License status can be verified at the Contractors State License Board. Work requiring a license is performed by licensed personnel. Retail supply sales do not require a contractor license.

Requests and quotes

When you submit a form on the Site, you are requesting that we contact you. Submitting a request does not create a service relationship and does not guarantee availability, scheduling, or pricing. Any pricing discussed before an on-site evaluation is an estimate and may change once we see the property, the equipment, and the condition of the water.

Accuracy of information

We work to keep the Site accurate and current, but we do not warrant that it is complete, error-free, or up to date. Service descriptions, service areas, hours, brand affiliations, equipment references, and warranty information may change without notice. Photographs are representative and may not depict work performed at your property.

Third-party brands and links

Equipment manufacturer names and logos appearing on the Site are the property of their respective owners and are used to identify equipment we service. Their appearance does not imply endorsement of SK Pools by those manufacturers except where we separately state an authorization. The Site links to websites operated by our affiliated companies and by third parties. We are not responsible for the content, accuracy, or practices of any site we do not control.

Our content

The text, photographs, graphics, logos, and layout of the Site are owned by SK Pools LLC or used with permission, and are protected by copyright and trademark law. You may view, download, and print pages for your own non-commercial use. You may not copy, republish, distribute, or create derivative works from Site content for commercial purposes without our written permission.

Acceptable use

You agree not to use the Site to submit false or misleading information, to submit another person's contact information without their permission, to attempt to gain unauthorized access to the Site or its systems, to interfere with its operation, or to collect information from the Site by automated means without our written consent.

Disclaimer of warranties

The Site is provided "as is" and "as available," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or free of errors or harmful components.

This section applies to the Site only. It does not limit, waive, or modify any warranty, guarantee, or obligation contained in a signed service agreement between you and SK Pools, or any right you have under the California Business and Professions Code or other applicable law.

Limitation of liability

To the fullest extent permitted by law, SK Pools LLC and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Site, or for any loss of data, revenue, or profits, even if advised of the possibility of such damages. Nothing in these Terms limits liability that cannot be limited under California law.

Indemnification

You agree to indemnify and hold harmless SK Pools LLC from claims, damages, and reasonable attorneys' fees arising from your misuse of the Site or your violation of these Terms.

Governing law and venue

These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Any dispute arising out of the Site or these Terms will be brought exclusively in the state or federal courts located in San Diego County, California, and you consent to that venue.

Changes to these Terms

We may revise these Terms at any time. Changes are effective when posted on this page with an updated effective date. Your continued use of the Site after changes are posted means you accept the revised Terms.

Severability

If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions will stay in full force.
